1. About these Terms
This website at cherkez.ae (the "Site") is operated by Cherkez Cherkesov, a cinematography practice based in Dubai, United Arab Emirates ("Cherkez", "we", "us", or "our"). 
By accessing or using the Site, you agree to these Terms & Conditions ("Terms"). If you do not agree, please do not use the Site.

2. The Site and what it does
The Site is a portfolio. It presents examples of our cinematography work, information about our service, and a way to request a discovery call. The Site does not sell products, process payments, or create accounts.
Booking a discovery call through the Site is a request for a conversation. It does not create a contract, a quote, or any obligation to perform services.

3. Service agreements are separate
Cinematography services are governed by a separate written agreement signed between Cherkez and the client for each specific project. Nothing on this Site — including descriptions of our service, process, indicative pricing, or response times — constitutes an offer or a binding commitment. The terms of any engagement, including scope, deliverables, fees, timelines, revisions, and intellectual property rights, are set out in the project agreement and prevail over anything stated on the Site.

4. Intellectual property
All content on the Site — including films, video, photographs, stills, text, graphics, logos, the "CHERKEZ" name and brand mark, and the overall design and arrangement of the Site — is owned by Cherkez or used with permission, and is protected by copyright and other intellectual property laws.
You may view the content on the Site for personal, non-commercial purposes. You may not copy, download, reproduce, republish, distribute, modify, adapt, frame, embed, scrape, or use any content from the Site for commercial purposes, training of artificial intelligence or machine learning models, or any other purpose, without our prior written consent.
The properties featured in our portfolio are shown with the consent of the relevant parties. Their inclusion does not grant you any rights in respect of those properties, their owners, or their representatives.

5. Acceptable use
You agree not to:

• Use the Site in any way that is unlawful, fraudulent, or harmful

• Attempt to gain unauthorised access to the Site, its servers, or related systems

• Introduce viruses, malware, or any other harmful code

• Use automated systems (including bots, scrapers, or crawlers) to access or extract content from the Site, except for legitimate search engine indexing

• Impersonate any person or misrepresent your affiliation with any person or entity

• Use any content from the Site to train artificial intelligence or machine learning systems
   

6. Third-party services and links
The Site uses third-party services, including but not limited to Wix (hosting), Vimeo (video playback), and Calendly (scheduling). The Site may also link to third-party websites. We do not control these services or sites, and we are not responsible for their content, availability, or practices. Your use of any third-party service is governed by that party's terms and policies.

7. No warranties
The Site and its content are provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Information on the Site is provided in good faith and is intended to give a general impression of our work; it may not be complete, current, or accurate at all times.

8. Limitation of liability
To the fullest extent permitted by applicable law, Cherkez shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunities, arising out of or in connection with your use of, or inability to use, the Site.
Our total aggregate liability arising out of or in connection with the Site, regardless of the cause of action, shall not exceed one hundred United Arab Emirates Dirhams (AED 100).
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law.

9. Privacy
Our handling of personal information is described in our Privacy Policy. By using the Site, you also agree to the terms of that Policy.

10. Changes to these Terms
We may update these Terms from time to time. The current version will always be available on the Site, with the date of the most recent update shown at the top. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.

11. Governing law and jurisdiction
These Terms are governed by the laws of the United Arab Emirates, as applicable in the Emirate of Dubai. Any dispute arising out of or in connection with these Terms or the Site shall be subject to the exclusive jurisdiction of the courts of Dubai.
